Past Due Invoices

Temporary Solutions invoice payment terms are Net 30, meaning that an invoice is considered past due if it is not paid within 30 days of the invoice date. For example, an invoice is one day past due if it is still unpaid 31 days after the invoice date.

Past Due Notifications

Temporary Solutions sends past due notifications to agency customer billing contacts at the following intervals:

  • First Notice when the unpaid invoice is 1-30 days past due
  • Second Notice when the unpaid invoice is 31-60 days past due
  • Notice of Pending Referral to the Attorney General’s Office when the unpaid invoice is 75 days past due
  • Referral to the Attorney General’s Office when the unpaid invoice is 90 days past due, as required by G.S. 147-86.11(e)(4)

Hiring Restrictions in G.S. 126-6.3(a2)

N.C.G.S. 126-6.3(a2) requires Temporary Solutions to prohibit from acquiring new temporary employees any Agency or division, based on individual budget code, having:

An invoice that is over 90 days overdue and a total overdue invoice amount exceeding $200,000 for any number of days.

When an Agency is restricted from acquiring a new temporary employee under G.S. 126-6.3(a2), the Agency shall not be allowed to acquire new temporary employees through Temporary Solutions until the Agency has paid all overdue invoices. This requirement does not apply to the North Carolina National Guard.

Temporary Solutions monitors the invoice status of each Agency customer with respect to this requirement. If an Agency customer reaches the statutory threshold for hiring restrictions to be implemented, it will notify the Agency’s HR Director, Chief Financial Officer, and the HR Representative of the affected work unit and explain how the restrictions will be enforced.

Reporting Requirements

Temporary Solutions reports at least monthly to the Director of OSHR the Agencies that have any past due invoices.

Additionally, G.S. 126-6.3(a5) requires Temporary Solutions to report quarterly to the Joint Legislative Oversight Committee on General Government and to the Fiscal Research Division on Agency compliance with G.S. 126-6.3, including:

  • Any Agency invoices with due dates greater than 60 days, and

  • Compliance with G.S. 147-86.11(e)(3) and (e)(4) as it relates to Temporary Solutions invoices
