The 31-Day Break Calculator

Temporary employees who have worked continuously for 11 months can be rehired for another temporary position if they have been without employment for at least 31 consecutive calendar days and return on the 32nd day. This “31-day break” or “break-in-service” ensures compliance with N.C.G.S. § 126-6.3(a3)(3). To simplify this, an online 31-day calculator has been made available for the convenience of both employers and employees to determine the correct return-to-work date.

Note: The 31-Day Break Calculator is intended to be a planning tool to estimate the reinstatement date of a temporary employee. The reinstatement date will populate automatically based on temp's last day worked.

The last day worked refers to the employee’s final day of recorded hours. The reinstatement date is the 32nd day, marking the end of a 31-day break during which the temporary employee is eligible to return to work.
