Onboarding that meets yours needs

Members receiving any type of payment will need to be onboarded to comply with federal tax requirements. We provide several onboarding options if your board, commission, committee, or council needs our services.

Understanding N.C.G.S. § 138-5

Your member is eligible for per diem under N.C.G.S. § 138-5 if:

  • Your State board, commission, committee, or council operates from funds deposited with the State Treasurer. G.S. § 138-5(a).

           AND

  • No part of your member’s salary is paid with State funds. G.S. § 138-5(f).

Until July 1, 2024:

Eligible members of the North Carolina Vocational Rehabilitation Council, the Statewide Independent Living Council, and the Commission for the Blind who are unemployed or who shall forfeit wages from other employment to attend Council or Commission meetings or to perform related duties, may receive compensation not to exceed fifty dollars ($50.00) per diem for attending these meetings or performing related duties, as authorized by sections 105 and 705 of the Rehabilitation Act of 1973, P.L. 102-569, 42 U.S.C. § 701, et seq., as amended. G.S. § 138-5(a1).

For all other eligible members of State boards, commissions, committees, and councils covered by N.C.G.S. § 138-5, the per diem amount is $15.00 for each day of service. G.S. § 138-5(a1).

Effective July 1, 2024:

The following applies to eligible members of all State boards, commissions, committees and councils which operate from funds deposited with the State Treasurer, excluding those boards, commissions, committees and councils the members of which are serving without compensation and excluding occupational licensing boards as defined in G.S. 93B1:

  • Eligible members of the North Carolina Vocational Rehabilitation Council, the Statewide Independent Living Council, and the Commission for the Blind who are unemployed or who shall forfeit wages from other employment to attend Council or Commission meetings or to perform related duties, may receive compensation not to exceed fifty dollars ($50.00) per diem for attending these meetings or performing related duties, as authorized by sections 105 and 705 of the Rehabilitation Act of 1973, P.L. 102-569, 42 U.S.C. § 701, et seq., as amended. G.S. § 138-5(a1).
  • Eligible members of the Board of Trustees of the Eastern North Carolina School for the Deaf, the Board of Trustees of the North Carolina School for the Deaf, and the Board of Trustees of the Governor Morehead School for the Blind may receive compensation not to exceed fifty dollars ($50.00) per diem for attending trustee meetings or performing related duties. G.S. § 138-5(a1).
  • For all other eligible members of State boards, commissions, committees, and councils covered by N.C.G.S. § 138-5, the per diem amount is $15.00 for each day of service. G.S. § 138-5(a1).

Also, all special statutory provisions relating to per diem, subsistence, and travel allowances must conform to G.S. 138-5. G.S. § 138-5(b).

5(a2). The subsistence reimbursement for actual lodging expenses provided in G.S. 138-5 must be documented by a receipt of lodging expenses from a commercial establishment. G.S. § 138-5(d).

Reimbursement of travel expenses at the rates allowed to State officers and employees by subdivisions (1) and (2) of G.S. 138-6(a). G.S. § 138-5(a3). Out-of-state travel on official business by members of State boards, commissions, committees and councils which operate from funds deposited with the State Treasurer shall be reimbursed only upon authorization obtained in the manner prescribed by the Director of the Budget. G.S. § 138-5(e).

Members of State boards, commissions and councils who are also members of the General Assembly shall receive, when the General Assembly is not in session, subsistence and travel allowances at the rate set forth in G.S. 120-3.1(a)(2) through (a)(4). G.S. § 138-5(f).

For convention registration fees, the actual amount expended, as shown by receipt. G.S. § 138-5(a4).

Yes. Eligible members who choose not to receive per diem payments or reimbursements for subsistence, travel, or registration fees are not required to be onboarded.

Per diem payments and reimbursements for subsistence, travel, and registration fees are taxable. Therefore, any eligible member who elects to receive any payment or reimbursement must complete the Federal Form I-9, Form W-4: Employee’s Withholding Certificate, NC-4: Employee’s Withholding Allowance Certificate, and the NC Direct Deposit Enrollment Form. Temporary Solutions will also use E-Verify to confirm the member’s eligibility to work in the United States.
