Required Use of TS by Cabinet Agencies

N.C.G.S. 126-6.3(a) states:

Use of Temporary Solutions Required for Cabinet Agencies. - Notwithstanding G.S. 126-5 or any other provision of law, all Cabinet agencies that utilize temporary employees to perform work that is not information technology-related shall employ them through the Temporary Solutions Program administered by the Office of State Human Resources (OSHR). Council of State agencies may use the Temporary Solutions Program in the discretion of the agency. 

For the purposes of this Section, Temporary Solutions considers a position to be “information technology-related” if the temporary position is classified in the state’s Salary Schedule DT.

List of NC Cabinet Agencies 

Cabinet agencies are led by Department Secretaries appointed by the Governor.  North Carolina’s Cabinet agencies are: 

Administration Military and Veterans Affairs 
Adult Correction Natural and Cultural Resources 
Commerce Public Safety 
Environmental Quality Revenue 
Health and Human Services Transportation 
Information Technology  

Exceptions to G.S. 126-6.3(a)

G.S. 126-6.3(a3)(1) states: 

  1. The Director of the OSHR may create exceptions to the requirements of subsection (a) of this section only when the following conditions are met:

    a.  The Temporary Solutions Program cannot meet the agency's employment needs for a class of temporary job assignments.

    b. Failure to recruit for the class of temporary job assignments will cause severe harm to the agency's ability to provide services to the public. 

 Requests for exception to G.S. 126-6.3(a) may be made at any time.  They are typically submitted between January and June to coincide with the start of the start of new fiscal year.  Please contact Joseph Gilroy, Temporary Solutions Manager, or Colie Cashwell, OSHR/TS Compliance Monitor for more information.
