Navigating the 31-Day "Break"
There are a few key compliance requirements to keep in mind when managing the 11-month limit and the 31-day mandatory separation. When reinstating your separated temporary, you can rest assured you’ve met these requirements by following the steps below.
Before your temporary separates, determine the date they will be eligible for reinstatement. N.C.G.S. 126-6.3(a) states: “A temporary employee shall only be eligible for reinstatement on the job assignment after working 11 consecutive months if the temporary employee is separated for at least 31 consecutive calendar days.” Our Return-to-Work Eligibility Calculator will help you determine the date your temporary employee will be eligible for reinstatement without having to count days on your calendar! You’ll just need the date of their last day worked as a temporary with the state.
Review the Temporary Solutions Payroll Deadlines Calendar. The Temporary Solutions Payroll Deadlines Calendar identifies the dates that job orders and onboarding packets must be in order to hire a temporary on your target date. Be sure to check this calendar before your temporary employee separates to ensure you don’t miss the deadline for submitting their reinstatement request.
Notify Temporary Solutions of your temporary employee’s separation. N.C.G.S. 126-6.3(a5) requires Cabinet and Council of State agencies to notify Temporary Solutions whenever any temporary separates for their 31-day “break” due to the 11-month limit. In addition to being a legal requirement, a timely separation leads to a more timely reinstatement.
Submit a Temporary Solutions job order to request reinstatement. Use our Job Order Portal to submit a reinstatement job order before the deadline you identify on our Payroll Deadlines Calendar. Submitting the job order will officially kick off the reinstatement process through Temporary Solutions.
Note: Each agency has its own process for requesting a temporary through Temporary Solutions. Please consult with your agency’s HR Division prior to submitting a job order.

Welcome back your temporary employee! During the onboarding process, your Temporary Solutions Placement Counselor will confirm your temporary employee’s approved start date. Make sure they’re ready to get back to work by following your agency’s internal onboarding process, which may include obtaining security permissions, state-issued equipment, and an NCID.
